Judge Therese Austin has put little weight on an the emailed certificate sent to Darwin local courts for the period 10th to 18th October, as it said Milgate was "unfit for work", however not unfit to appear in person or via telephone.
Milgate also outlined in her correspondence to the registry office this week her intention to request judge Austin recuse herself from hearing her matter, but didn't read out the reasoning in open court.
The crown prosecutor was unable to confirm whether he would be pursuing the arrest warrant without instructions, but told her honour that she had the power to do so without him pressing the matter, which she already knew.
In a stern voice judge Austin reminded the court it wasn't her first non-appearance, during a detailed decision in a hearing that went for 20 minutes.
The former realestate agent is on bail and risks spending time in lockup if she doesn't get over here toot sweet and sort it out.
