The owners of a Katherine home on Herbert Court appear likely to lose their home, after an order was granted against two defendants for the repossession of the property.
Justice Luppino started proceedings this morning in court room four: "Can we have the two defendants called?"
Staff returned without the defendants.
The lawyer for People's Choice began: "Today we're looking for repossession of the property at xx Herbert Court in Katherine.
"The motion was served on the first and second defendants on the 1st of February.
"The proceedings were filed on the 30th April, and they were served on the first and second defendant on the 16th May.
"They were personally served, as filed in the affadavit (with more legal jargon I won't fill your head with).
Justice Luppino said he didn't require the financial figures be read out in court.
The lawyer continued: "Nothing further from us your honour, other than the mortgage has not been paid since July last year.
"The last three payments were on the 27th and 30th of July (last year).
"A total of $1,000."
Justice Luppino responded: "I commonly see that.
"I'm amazed at how long financiers allow defaults to continue before they take any action."

"Even then after an order is made, they take what appears to be an eternity to get a warrant issued and executed, but then, that's a matter for them.
"Have you or your clients had any communication from the defendants?"
Lawyer for People's Choice: "No we haven't your honour. They, as you know, have been personally served.
"They have chosen not to take part in these proceedings."
Justice Luppino asked: "You know they are still occupants of the property?"
Lawyer: "As far as I'm aware."
Justice Luppino "I make as orders one and two. Orders pursuant [barely audible] to those same paragraphs in the orders."
